Terms and Conditions for Flagstaff Stargazing Adventures, LLC
Welcome to Flagstaff Stargazing Adventures' website (flagstaffstargazing.com). By accessing our website or using our services, you agree to the following terms and conditions.
Booking and Payment:
All bookings for stargazing tours and events are processed through our website or by email info@flagstaffstargazing.com. For direct private bookings, any required deposit is due at booking and the remaining balance is due 14 days before the scheduled start. Bookings within 14 days require full payment at booking. For custom events and star parties, a 20% non-refundable deposit reserves the event date; the remaining 80% is due 30 days before the start. Events booked within 30 days require full payment at booking. Card payments have a 2.9% processing fee, non-refundable once processed except where required by law or when Flagstaff Stargazing Adventures cancels for reasons unrelated to weather and cannot reasonably provide or reschedule the service. Separately agreed written payment, cancellation and refund terms for resorts and partner organizations take precedence.
Confirmation and Itinerary:
Upon receipt of payment, we will send a confirmation email to the email address provided during the booking process. The email will include the date, time, and location of your stargazing event, as well as any other pertinent details or instructions. Itineraries are built with safety as the top priority, and subject to change due to weather or safety concerns. Itineraries are written for many reasons, but come from a base of combined decades of experience.
Cancellation and Refund:
Direct Private Bookings
Guest cancellations received at least 7 days (168 hours) before the scheduled start are eligible for a refund of tour charges. The 2.9% card processing fee is non-refundable once processed, except where required by law or when Flagstaff Stargazing Adventures cancels for reasons unrelated to weather and cannot reasonably provide or reschedule the service. Cancellations received less than 7 days before the start, including no-shows, are non-refundable and the full reservation amount remains due.
Custom Events and Star Parties
For client cancellations received at least 30 days before the start, the 20% deposit remains non-refundable and payments above it are refunded minus other non-refundable fees or add-ons. Within 30 days, including no-shows, the full contracted amount is non-refundable and remains due.
To request a cancellation or refund, email info@flagstaffstargazing.com with your booking confirmation number. Separately agreed written payment, cancellation and refund terms for resorts and partner organizations take precedence.
Weather:
Flagstaff Stargazing Adventures determines whether conditions allow a safe and meaningful experience. If we cancel due to weather, whether your booking is fully or partially paid, payments above the deposit are refunded minus the 2.9% card processing fee and any separately disclosed non-refundable add-ons. The processing fee is deducted only once. Your deposit remains a credit toward a future experience; this credit does not expire and may be transferred. If the experience remains scheduled and you choose not to attend based on a forecast, the guest-cancellation terms apply.
Other Cancellations by Flagstaff Stargazing Adventures:
If we cancel for reasons unrelated to weather and cannot reasonably provide or reschedule the service, all payments made, including the 2.9% card processing fee, will be refunded.
Equipment and Supplies:
We provide all necessary equipment for stargazing, including telescopes, binoculars, and blankets. We also provide snacks and beverages, as specified on our website. Customers are responsible for bringing their own warm clothing, as temperatures can drop significantly at night in Flagstaff.
Assumption of Risk:
Stargazing involves certain inherent risks, including but not limited to, slips, falls, and injury from equipment or other stargazers. By participating in our stargazing events, you assume all risks associated with such activities.
Limitation of Liability:
Flagstaff Stargazing Adventures, LLC is not liable for any personal injury, loss, or damage to property that may occur during our stargazing events. By participating in our events, you agree to release us from any liability, claims, and damages arising from or in connection with your participation in our events.
Intellectual Property:
The contents of this website, including but not limited to text, graphics, images, and logos, are the property of Flagstaff Stargazing Adventures, LLC, and are protected by copyright and trademark laws. You may not copy, reproduce, distribute, or modify any content on our website without our prior written consent.
All photographs taken during our stargazing events are the property of Flagstaff Stargazing Adventures, LLC, and may not be used for commercial purposes without our prior written consent. Customers may use photographs for personal, non-commercial use only, and must not remove any watermarks or logos without our written consent.
Governing Law:
These terms and conditions are governed by the laws of the state of Arizona, and any disputes arising from or in connection with these terms and conditions shall be resolved in the courts of Coconino County, Arizona.
Changes to Terms and Conditions:
We reserve the right to modify these terms and conditions at any time without prior notice. By continuing to use our website or services after any modifications, you agree to be bound by the updated terms and conditions.
